I am aware that products within the EU must comply with RoHS and this has been the case since 1st July 2006.
However despite the legal requirement for a product to comply with RoHS, is it possible that a product can carry the CE Mark and not comply with RoHS?
I have a manufacturer who wishes to supply into the EU a product which has a non compliant RoHS component, but the product carries the CE Mark. I have advised that legally this product cannot enter the EU until the RoHS issue is resolved and this has been accepted, but the big question is does this make the CE Mark invalid?
