Shipment Delayed - No Op's Manual

Can a CE-Marked product shipment be seized or delayed if there is not an accompanying Operator's Manual in the receiving country's primary of secondary language?

In the Machinery Directive there is a requirement that the manual should be provided with a translation into the language of the country in which it is going to be placed on the market. Is your product a machine?

The lack of having a translation in the official language is a formal ground for refusing the CE marking.

But I am quite surprised that the authorities show themselves so stringent when about a second official language.

Which country is demanding the translation in the second language?

Hazu,

First, thank you for taking the time to answer my post. We haven't had the issue of refusal due to lack of a second language present itself but want to be prepared. My real question is, if we didn't have the manual translated into the primary language of the country of destination can we still send it with an English manual if it's a recognized secondary langauage?

According to the requirements of the Machinery Directive a translation of the manual must be provided. So if your product is a machine, a translation must be provided. If the translation is not available, you would not be allowed to affix the CE marking.

So be prepared for questions by the authorities.

How have you arranged for the translation? What languages do you need?
